Seller's Terms

The following terms apply to this Online Auction exclusively. By participating in this online auction, you agree to abide by these terms and conditions. “Seller” means Precise Printing Equipment the user on the website who is offering the items and goods for auction.

1. ALL ITEMS ARE SOLD AS IS, WHERE IS, WITH NO WARRANTIES OR RETURNS.

2. Binding Contract: If you are the highest bidder on a lot when the lot closes, you agree to purchase that lot for the hammer price plus the buyer's premium and any other fee's that apply. Please bid responsibly.

3. Buyer's Premium: You agree to pay a buyer's premium of 9.5% of the hammer price in addition to the hammer price of any lot you win. This premium will be added to the hammer price in your invoice to the winning bidder.

4. Payment: Full payment for any lot must be received by the seller before 5:00 p.m. (PST) on Friday, February 21st, 2014. The seller accepts the following forms of payment: Cash, Major Credit Card, Wire Transfer, or PayPal. (We will not charge an additional fee for credit card or PayPal purchases) Buyers Premium and Sales Tax applicable. Checks (domestic only) will require a minimum of 5 business days to process and clear prior to item removal, Checks will not be accepted from international buyers. Invoice balance must be paid prior to the payment dead-line, all shipping quotes accepted will be billed separately.

* International Customers: We require all international purchases to pay by Wire Transfer only!

5. Removal: You may not remove or take possession of any lot until the seller receives payment in full for that lot. You must present proof of payment to the seller upon pickup, and/or sign a waiver provided by the seller prior to lots shipment.

* International Customers: Lot and Item Removal must be scheduled immediately after payment, we will load your provided container or truck at an additional applied fee per container. Items and lots that are not removed will incur a $0.95 square foot per month storage fee until the item is picked up and removed after 15 days of the auctions close date, unless other prior arrangments have been made.

6. Removal dates: Lots will be available for pickup on these dates: 9:00am to 4:30pm (PST) Monday - Friday 
(Saturday by Appointment Only!)

- All lots must be removed before Friday, February 28h, 2014 by 4:30 p.m. (PST). Contact us directly to make other arrangements or to notify us of a delay in item pickup. A storage fee may apply to items held past the pickup dead line of $0.95 per square feet per month after 15 days of the auctions close date, unless other prior arrangments have been made.

7. Preparation of lots: Seller will make reasonable efforts to make the purchased lots accessible to the winning bidder on the dates of removal. Seller will not be responsible for securing or unloading lots once they are loaded at our facility. Photos will be taken of all item(s) prior to loading and kept by the seller. Any damage or liability caused by incorrectly securing the item(s) will be the sole responsibility of the Purchaser. Arrangements must be made and removal must be done in a timely fashion, failure to contact us and schedule a pickup time will result in bid forfeiture and a breach of the terms and conditions.

8. Complete agreement: These terms and conditions, together with all other posted notices and/or additional terms provided in the description of any individual lots within this auction, constitutes the entire terms and conditions on which property listed in the auction sale catalog, shall be offered for sale or sold by Seller. No oral agreements made between Buyer and Seller shall be valid unless memorialized by both parties in writing. Seller strongly recommends to all bidders to thoroughly inspect all items carefully before the auction on which the bidder intends to commence and commit to bidding. By placing a bid on any lot, will constitute as acceptance to the terms and conditions of this auction.

9. Auction site: Bidder acknowledges that an auction site is a potentially dangerous place. Flammable, noxious, corrosive and pressurized substances may be present, heavy equipment may be in operation, and electric circuits may be live. Every person at the auction site before, during and after the auction sale, shall be deemed to be there at his/her own risk with notice of the condition of the premises, the activities on the premises, and conduct of third parties; and the bidder shall so advise his/her agents and employees. No person shall have any claim against Seller, its consignors, agents, employees, directors or principals for any injuries sustained or for damages to or loss of personal property, which may occur from any cause whatsoever. No children under the age of 18 years of age will be allowed on the property.

10. Requital: If Seller is unable to deliver any lot or any necessary documentation required in respect of any lot and as stated in the lots description, the Purchaser’s sole and exclusive liability shall be the return of any monies paid on such lot.

11. Returns, Refunds, Exchanges, and Warranty: Absolutely NO RETURNS of sold goods, NO REFUNDS, and NO EXCHANGES will be permitted. Additional items that are not listed in the lot description will not be included. This includes: manuals, parts, tools, power adaptors, etc. Please read through each lot description carefully. All items will be sold AS-IS, WHERE-IS. No warranties will be given for any lot. Testing or powering items during pickup is also prohibited.

12. Removal: No article shall be removed unless paid for in full and all articles purchased shall be removed within the time period herein provided in the specific terms and conditions of this auction.

13. Payment Dead Lines: Time shall be of the essence. If the Purchaser fails to make payment or remove goods within the time periods herein provided, the Auctioneer may resell the article purchased by auction, private contract or otherwise, as the Seller in his discretion deems advisable. If the Purchaser fails to pay the seller in full for his item by the payment due date, the Purchaser shall owe Seller liquidated damages, deinstallation, loading, rigging, transporting, storage, and/or a remarketing fee, in the amount of 25% of the hammer price of that item, or the difference of the items hammer price if it is relisted and sold within the time frame of seven (7) days after the auctions close date. A $35.00 non-refundable processing fee will also be applied to each lot that is relisted due to bid forfeiture, all non-paying bidders will be suspended from future auctions, and may be sent to a collections agency.

Bidding on any lot constitutes acceptance of these terms and conditions. 
We kindly ask if you have no intentions on paying for a lot, do not bid. All non-paying bidders will be suspended from all future auctions and pursued by our legal department for the collection of the remarketing fees listed above in item #13 Payment Deal Lines.

Shipping Info

Ground access for small and large vehicles including semis and trailers. Fork lifts and pallet jacks are available. Street parking is at a first come basis, reserved parking will not be provided. Numerous bays are available for loading. No loading docks are available and no overnight parking will be available. Straps and tie-downs are not included "you must bring your own straps and you must secure your own load" we will not allow items to leave the property without being properly and safely secured and we will not be held liable for any of the items once they leave the premises. Seller assumes no liability for damages or injuries occurred during moving, loading, or transporting of item(s).

IMPORTANT NOTE: Buyer is responsible for de-installation, loading, and removal of all items. If you would like us to de-install and/or load items onto your truck or container, please contact Precise Printing Equipment directly for additional information and cost.

International Shipping Information: We have the capability to load your container for shipping overseas! There will be an applied fee per container regardless of total items won. We are located near the Port of Long Beach which is one of the busiest ports in the world and has the most competitive rates for international shipping. We prefer all international customer schedule they're own trucks or containers for removal and coordinate with us directly.

Crating and Skidding: (international and domestic) is available at an additional charge. In the description of each lot, a palletizing and loading costs are explained.

Equipment Deinstallation and Take Apart: The buyer of each lot is responsible for deinstallation and take apart the equipment that is noted in the description of each lot requiring deinstallation. Precise Printing Equipment will professionally deinstall and load such items at an additional cost. Contact us directly for cost and to make arrangements. All Items must be removed promptly after the end of the auction and payment has been cleared, we ask that you stay in contact with us directly during the process. Additional fees will apply for storage, deinstallation, rigging, and loading that is done by us which will be billed directly to your company, if you fail to provide your own means of deinstallation, loading, and removal.

Normal shipping and handling charges will apply for any items requested to ship via USPS, UPS, FedEx, DHL, and all other courier services. You may use your own shipping account information or we will ship the item out for you and add the total shipping charges to the final invoice.
