Terms: Machines Auctioneer offers items from third parties. We cannot guarantee the quality or accuracy of items available by third parties. All items are sold “AS IS”. We do not provide any warranties or guarantees. It is the Buyer’s responsibility to read all the Seller’s terms and conditions, including the terms listed in the description under each listing.

Binding Contract: If you are the highest bidder on a lot when the lot closes, you agree to purchase that lot for the hammer price plus the buyer’s premium.

PLEASE DO NOT BID IF YOU CANNOT SECURE PAYMENT BY THE PAYMENT DEADLINE. YOUR ACCOUNT WILL BE FLAGGED IN THE EVENT OF NON-PAYMENT.

Buyer’s Premium: You agree to pay a buyer’s premium of 10% of the hammer price in addition to the hammer price of a lot you win. This premium will be added to the hammer price in your invoice.

Payment: Full payment must be received by the seller before the payment deadline. You have three (3) business days from the day the auction closes to make payment. Please refer to the Seller directly with questions about payment types or if you do not receive an invoice. There is a 3% fee for all credit card transactions. First time Buyer’s have a credit card purchase maximum of $3,000. If purchase is over $3,000.00, please contact Machines Auctioneer for alternative payment options. If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reserve your transaction. We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Item Descriptions: Most of our machines are purchased from leasing companies, and every machine was previously under a service contract. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from Machine's Auctioneer at your own risk. All items are presumed to be in working condition when taken out of service unless otherwise stated in the item’s description. You are bidding on the item(s) shown in the images and/or video. We have done our best to provide as much information about the equipment as possible. All descriptions are written to best fit each item, but some descriptions may be taken from the manufacturer’s website. Please note that features can change and there may be issues we are not aware of. If there is any discrepancy between the written description and the images, please refer to the images. If in doubt about an item, it is the Buyer’s responsibility to contact the Seller before bidding. We will do our best to answer your questions, but we may not be able to provide every specific detail of every machine.

Shipping: You may not take possession of any item(s) until the Seller receives payment in full. Shipping will not be arranged until payment has been received and processed. When you purchase items from Machines Auctioneer, the items will be delivered through DeliveryMatic unless Buyer declines service and arranges delivery through preferred method at own cost. Please allow six (6) weeks after the purchase of an item to file any actions. This allows time for the item to be delivered to Buyer.

IF THE SELLER OR ITS CONSIGNOR IS UNABLE TO DELIVER ANY LOT, THE BUYER’S SOLE AND EXCLUSIVE LIABLITY SHALL BE THE RETURN OF ANY MONIES PAID ON SUCH LOT.

Consumer Protection Law: Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability: Machines Auctioneer and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity: Except where prohibited by law, by purchasing from Machines Auctioneer you indemnify and hold harmless Machines Auctioneer and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of you use of Machines Auctioneer or your violation of these Terms and Conditions.

Applicable Law: These Terms and Conditions are governed by the laws of the State of Texas.

Severability: If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed form the Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes: These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our service and the way we expect Buyers to behave. We will notify users by email of any changes to these Terms and Conditions or post a notice on Machines Auctioneer.

Complete Agreement: These terms and conditions, together with any posted notices and/or additional terms provided in the description of any lots within this auction, constitutes the entire terms and conditions on which property listed in the auction sale catalog shall be offered for sale or sold by Seller or any consignor of such property for whom Seller acts as agent. No oral agreements made between Buyer and Seller shall be valid unless memorialized by both parties in writing.
