The following terms apply to this Online Auction. By participating in this online auction, you agree to abide by these terms and conditions. “Seller” means Letterpreservation, the user on the website who is offering the goods for sale.
ALL ITEMS ARE SOLD AS IS, WHERE IS, WITH NO WARRANTIES OR RETURNS.
Binding Contract - If you are the highest bidder on a lot when the lot closes, you agree to purchase that lot for the hammer price plus the buyer's premium. Please bid with care.
Buyer's Premium - You agree to pay a buyer's premium of 10% of the hammer price in addition to the hammer price of any lot you win. This premium will be added to the hammer price in your invoice.
Payment - Full payment for any lot must be received by the seller within 3 Business Days of the auction. The seller accepts the following forms of payment: Cash, Cashiers/Bank Check, Money Order, Wire Transfer, ACH (Electronic Check), Discover, Visa, MasterCard.
Removal - No lot may be removed or taken possession of until the seller has received full payment for that lot. Proof of payment must be presented to the seller upon pickup. All articles purchased must be removed within the removal deadlines listed in Section 6 of these Terms & Conditions. Failure to remove purchases within the designated time may result in additional storage charges or abandonment of the item, at the seller's discretion.
All lots must be removed before within 10 Business days of the auction end date.
Special exceptions can be made for large items or bidders loading overseas shipments.
LTL Freight Shipments - Items requiring LTL freight shipment, defined as weighing over 100 pounds or exceeding standard parcel carrier size limits, will require packaging at the buyer’s expense. Packaging fees will vary depending on the size, weight, and complexity of the item. Packaging charges are separate from the purchase price and must be paid prior to release of the item. Please contact us prior to bidding if you would like an estimated packaging cost for a specific lot.
Large Items - LTL Shipping Arrangements:
Buyer Arrangements: Buyers to arrange their own LTL shipping and insurance and will be required to sign a waiver stating they take responsibility for any damage that might occur. This waiver is required because LTL carriers generally only insure used equipment for $0.01 per pound.
All items must be removed within the time-frames outlined in Section 6 unless otherwise agreed to in writing.
Any item not removed within 15 days after the auction closes, or 10 days after packaging notification (whichever is later), will begin incurring storage charges, unless other arrangements have been made in writing. Storage is billed at a rate of $50 per pallet position (4'x4') per month, rounded up to the nearest whole pallet and whole month. Storage charges must be paid in full prior to item pickup.
If an item is not removed within 30 days without prior arrangements, the buyer will receive a final notice allowing an additional 15 days to remove the item or pay any outstanding storage fees.
If no action is taken within the final notice period, the item will be considered abandoned, and the seller reserves the right to resell, dispose of, or otherwise manage the item without further liability. No refunds, charge-backs, or compensation will be provided for abandoned items.
Alternatively, at the seller’s sole discretion, and in lieu of declaring an item abandoned, the seller may choose to refund the buyer the purchase price paid, less any applicable storage, packaging, or administrative costs, and cancel the sale.
Preparation of lots - Seller will make reasonable efforts to make the purchased lots accessible to the winning bidder on the dates of removal. Seller will not be responsible for securing or unloading lots once they are loaded at our facility. Any damage or liability caused by incorrectly securing items will be the sole responsibility of the Purchaser.
Complete agreement - These terms and conditions, together with any posted notices and/or additional terms provided in the description of any lots within this auction, constitute the entire terms and conditions on which property listed in the auction sale catalog shall be offered for sale or sold by Seller, and any consignor of such property for whom Seller acts as agent. No oral agreements made between Buyer and Seller shall be valid unless memorialized by both parties in writing. Seller strongly recommends to all bidders to thoroughly inspect all items before the auction on which bidder intends to bid.
Shipping Terms
If Seller or its consignor is unable to deliver any lot or any necessary documentation required in respect of any lot, the Purchaser’s sole and exclusive liability shall be the return of any monies paid on such lot.
Absolutely NO RETURN of sold goods, NO REFUNDS, and NO EXCHANGES will be permitted.
Storage, Abandonment, and Non-Removal Policy
This auction is conducted as a reserve auction, and the seller reserves the right to bid.
Time shall be of the essence. If the Purchaser fails to make payment or remove goods within the time periods herein provided, the Auctioneer may resell the article purchased by auction, private contract or otherwise, as the Seller in his discretion deems advisable. If the Purchaser fails to pay the seller in full for his item by the payment due date, the Purchaser shall owe Seller liquidated damages in the amount of 25% of the hammer price of that item.
Letterpreservation is the "agent of sale" only; we fill out and file NO paperwork to assist with exportation.
