When there is a discrepancy between the written description and the actual item, the photographs will win out. You are bidding on the items in the photographs, not the written descriptions. All items are sold AS-IS, WHERE-IS with NO WARRANTIES. Lot closing times will extend 5 minutes every time a bid is placed within 5 minutes of close.

SELLERS TERMS

The following terms apply to this Online Auction. By participating in this online auction, you agree to abide by these terms and conditions.

1. ALL ITEMS ARE SOLD AS IS, WHERE IS, WITH NO WARRANTIES OR RETURNS.

2. Binding Contract: If you are the highest bidder on a lot when the lot closes, you agree to purchase that lot for the hammer price plus the buyer's premium. Please bid responsibly.

3. Buyer's Premium: You agree to pay a buyer's premium of 10% of the hammer price in addition to the hammer price of any lot you win. This premium will be added to the hammer price in your invoice.

4. Payment: Full payment for any lot must be received by the seller before payment deadline. Please refer to the seller directly regarding payment types and due dates.

5. Removal: You may not remove or take possession of any lot until the seller receives payment in full for that lot. Please refer to seller directly for shipping.

6. Complete agreement: These terms and conditions, together with any posted notices and/or additional terms provided in the description of any lots within this auction, constitutes the entire terms and conditions on which property listed in the auction sale catalog shall be offered for sale or sold by Seller, and any consignor of such property for whom Seller acts as agent. No oral agreements made between Buyer and Seller shall be valid unless memorialized by both parties in writing. Seller strongly recommends that all bidders thoroughly inspect all items before the auction for which the bidder intends to bid.

Terms for Sale and User Agreement

Please be sure to read the terms and conditions carefully before making a purchase.  The pre-owned item listed is expected to offer you, the buyer, a fantastic bargain. We make our best effort to provide a proper description of the items that we are listing; however, please consider the following observations:

1. Please carefully read the complete description of the item you are interested in buying before making the purchase.
2. In many cases, we rely on the internet and manufacturer-based information, which is always subject to change.
3. When selling an older product, there may be instances where we do not have accurate information; therefore, purchasers must conduct their own research and be aware of what they are buying.  
4. The photo's color may differ from the real product due to the constraints of translation and reproduction in photography.
5. Please take note that what you see in the pictures and read in the description is what you'll get with your purchase. Anything not shown or mentioned is not included.
6. We encourage you to conduct thorough research and ensure that the product you are purchasing will be useful for you or your business.
7. Large and heavy items require an LTL shipment; additional costs for skidding/crating will apply. These costs are in addition to the actual shipping charges paid by the buyer.
8. The seller is not responsible for any accidental or intentional use or misuse of the items sold on their behalf.

  9.  The buyer assumes full risk of shipping, and it is the buyer’s responsibility to request and pay for insurance.

The seller is listing and selling used goods and equipment (hereinafter collectively referred to as "goods"). Unless otherwise specifically agreed to in writing by Seller and Buyer:

All goods are sold "AS IS' and "WITH ALL FAULTS, meaning, without limitation, that: The items or equipment you are purchasing are used, and it does not guarantee the life expectancy of any existing parts. No Warranties of any kind are expressed, implied, or statutory, including implied warranties of merchantability or fitness for a particular purpose or use.  All items are sold "As Is," and NO RETURNS will be accepted for such items. Highly recommended to have the installation and setup performed by a trained technician.

Seller makes no representations that said goods comply with any Federal, State, or local law, requirements, or standards; and Buyer assumes the entire risk as to all of the same upon Buyer taking possession of the goods.

When we sell you an item, you agree that it is sold as is, where is and that we are not liable for any damage or injury that may occur during use or improper disposal of that item. When you purchase an item from us, you are responsible for verifying its safety. If you are a professional with the ability to assess safety and usability, you acknowledge that you are responsible for doing so. If not, you must have the item verified and/or tested by a professional to ensure its safety before use. New, used, and/or parts.

The Buyer assumes the entire risk upon taking possession of the goods. The Seller makes no representations as to the condition, quality, danger, adequacy of installation, adequacy of warning labels, performance, or operating manuals, or safe operation of, or latent or unknown defects respecting the goods. 

Buyer must conduct or obtain their own pre-purchase inspection of the goods. And the buyer's decision to purchase goods shall be based solely upon the buyer's judgment as to the suitability of said goods for the buyer's intended uses.

Buyer agrees to defend, indemnify and hold harmless the Seller, its directors, employees and other agents and representatives from and against any and all liabilities, judgments, penalties, claims, settlements, losses, damages, obligations and expenses (including attorney's fees and expenses and other professional fees and expenses), incurred or suffered by any persons or entities arising from, by reason of, or in connection with any loss, damage or injury to person, entity or property arising from, by reason of, or in any way connected to the goods sold. Buyer acknowledges that his sole and exclusive remedy shall be limited to return goods and repayment of the price, or to repair and replacement of nonconforming goods or parts.

Warranty/ Returns policy:

As stated earlier, we make every effort to provide precise descriptions of our items. If you happen to spot an error or have any questions about a product, please feel free to contact us.  We are here to help and make sure you are satisfied with your purchase.

Dead On Arrival (DOA) policy does not apply

The Seller is not an authorized distributor, representative, reseller, or affiliated with any manufacturer, brand, or product.  Items being sold are not covered under any manufacturer's warranty.   All trademarks, brand names, and brands appearing herein are the property of their respective owners.  

All transactions are agreed to have taken place in Rome, Georgia 30161, USA, and are governed by the laws of the state of Georgia.

Shipping :

The shipping cost has not been specified.

If you would like to check on shipping yourself, please don't hesitate to contact us to provide the information about the skid dimensions and weight. The buyer will then be responsible for scheduling the pickup and sending us the Bill of Loading before the truck arrives at our facilities to collect the item.

Local pickup

You are welcome to pick up your items by appointment only. Monday To Friday 8:00 AM - 5:00 PM Eastern Time Zone.  Rome, GA 3016, For large and heavy items, loading is always FREE of charge. 

Payment is required before any item can be shipped. Items will be shipped within 2-5 business days of cleared payment.

Additional costs for banding, stretch wrap, and skidding/crating will apply.

If you need help from us to ship your item, please let us know. You agree to pay the freight and shipping costs, in addition to the hammer price, for any lot you win. This cost will be added to the hammer price in your invoice.

Domestic Shipping Only (48 continental US States only) 

We always provide tracking numbers.

We ship almost all items within 2-5 business days of cleared payment.  We ship USPS, FedEx, and UPS.  Please note that you will be charged for shipping.  For small items, shipping cost is always based on your zip code or location. We don’t have a fixed price because each package and/or destination has its rate. We charge what it costs to pack and ship each item.

We do not ship to Hawaii, Alaska, Puerto Rico, Guam, or any other U.S. island territories, or other countries. 

Freight shipping only applies to the lower 48 continental US States.

For large and heavy items, please send us an email to inquire about the shipping cost. Please ensure that you provide all necessary delivery contact information, including the name of the company, shipping address with zip code, contact person, phone number, and hours of operation.  We also need to know if you have a dock or forklift, and if your location is a business. If freight shipping requires redelivery, lift gate service, or residential delivery charges, these will be billed to you if the trucking companies charge us extra for them.
