Lot #46: M&R VITRAN II UV Dryer

The following terms apply to this Online Auction. By participating in this online auction, you agree to abide by these terms and conditions. “Seller” means Intercommerce L.L.C., the user on the website who is offering the goods for sale.

ALL ITEMS ARE SOLD AS IS, WHERE IS, WITH NO WARRANTIES OR RETURNS.

1)  Binding Contract:

a)       If you are the highest bidder on a lot when the lot closes, you agree to purchase the lot for the hammer price, buyer's premium, plus Shipping & Handling. Please bid with care.

2)  Buyer's Premium:

a)       You agree to pay a buyer's premium of 10% of the hammer price in addition to the hammer price and Shipping & Handling of any bid you win. This premium will be added to the hammer price in your invoice.

3)  Payment:

a)      Full payment for any lot, Buyer’s Premium, and Shipping and Handling must be received by the seller before 2:00 PM CST; Within 3 Business Days of the end of the auction. 

b)     The seller accepts the following forms of payment:

i)        Cash, Cashiers/Bank Check, Money Order, Wire Transfer, ACH (Electronic Check), and Business Check

c)      If the Buyer fails to pay the seller in full for the item by the payment due date, the Buyer shall owe the Seller liquidated damages in the amount of 25% of the hammer price of that item

4)      Preparation of items won:

a)      The Seller must receive a signed Buyer's Liability Waiver prior to scheduling pickup. 

b)     The seller will make the purchased items accessible to the winning bidder on the agreed dates for removal. 

5)      Pickup: 

a)      No equipment or items may be taken into possession until the seller has received full payment for that lot, the buyer's premium, plus Shipping & Handling, and signed a liability waiver. 

b)     Proof of payment must be presented to the seller upon pickup. 

c)      All items/equipment must be picked up within **10 Business days of the auction end date. **Exceptions may be requested for buyers shipping overseas

i)         Failure to schedule / pickup purchases within the designated time may result in additional storage charges or abandonment of the item, at the seller's discretion.

d)     Lots will be available for pickup on these days and times:

i)         Monday through Friday, 8:00 am to 4:00 pm; Saturdays: Appointment ONLY

e)      Loading Assistance is only available upon request, and the buyer has received confirmation from the Seller of the date and time.

6)      Pickup Location:

a)      The Pickup location is a commercial warehouse located in South Sioux City, NE. 

7)      Shipping Terms - Buyer Arrangements:

a)      The Seller will not be responsible for any handling, crating, scheduling, or shipping of items unless a written agreement issued by the Seller states otherwise.

b)     All shipping costs and arrangements, including but not limited to all products used for handling/crating/loading/securing/shipping, are the sole responsibility of the Buyer. 

i)         These are additional costs to the purchase/premium buyer's price. 

c)      Buyers will be required to sign a waiver acknowledging responsibility for any damage that may occur.

Intercommerce L.L.C. is the "agent of sale" only; we will not fill out or file 

any paperwork to assist with exportation.

 No refunds, chargebacks, or compensation will be provided for abandoned items.

8)      Storage, Abandonment, and Non-Removal Policy:

a)      All items must be removed within the timeframes outlined in Section 5c unless otherwise agreed to by email.

i)         Storage charges will begin on the 11th day and will be charged as follows

$50 per item / per week beginning on the 11th day.

ii)   Storage charges must be paid in full by the buyer before the item is picked up.

b)       If no arrangements have been made within 20 days, the buyer will receive a notice allowing an additional 10 days to remove the item or pay an extra $100 per item / per week in storage fees beginning on day 31.

c)      If no action is taken 45 days after the auction end date, the item will be considered abandoned, and the seller, in their discretion and as they deem advisable, reserves the right to manage the items without further obligation to the buyer.

Complete agreement - These terms and conditions, together with any posted notices and/or additional terms provided in the description of any lots within this auction, constitute the entire terms and conditions on which property listed in the auction sale catalog shall be offered for sale or sold by Seller, and any consignor of such property for whom Seller acts as agent. 

Seller strongly recommends that all bidders thoroughly read all information regarding the equipment and shipping details before bidding.

Shipping Terms

• All shipping arrangements, including handling/crating/shipping, are the sole responsibility of the Buyer. 

•  Buyers are responsible for all costs incurred for scheduling, packaging, and shipping. These additional costs are NOT included in the bidding/buyer’s premium purchase price. 

• Buyer will be required to sign a waiver acknowledging responsibility for any damage that may occur.
